Welcome to PlushifyMe! These Terms of Service ("Terms") govern your access to and use of PlushifyMe's website, services, and applications (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

You must be at least 13 years old to use the Service. If you are under 18, you must have your parent or guardian's permission to use the Service.

PlushifyMe is an AI-powered service that transforms uploaded photos into plushie designs. The Service allows you to:

• Upload photos (people, pets, or objects)
• Generate AI-created plushie designs from your photos
• Download high-resolution plushie images
• Store your generated plushies in a personal gallery
• Manage your account and credits

PlushifyMe provides digital plushie designs only. We do not manufacture or ship physical plushies. The generated designs can be used to create physical plushies through third-party manufacturers.

3. Account Registration

3.1 Creating an Account

To use PlushifyMe, you must create an account using Google OAuth authentication. By creating an account, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities under your account

3.2 Account Security

You are responsible for maintaining the confidentiality of your account. PlushifyMe is not liable for any loss or damage arising from your failure to protect your account credentials.

3.3 Account Restrictions

• One account per person
• Accounts cannot be shared or transferred
• You must be a real person (no bots or automated accounts)
• You must comply with all applicable laws and regulations

4. Credit System

4.1 How Credits Work

PlushifyMe operates on a credit-based system. Each credit allows you to generate one plushie design. Credits are consumed when you successfully generate a plushie.

4.2 Purchasing Credits

• Credits can be purchased through our pricing plans
• All credit purchases are final and non-refundable (subject to applicable laws)
• Credits from different purchases are combined in your account
• We reserve the right to change credit prices at any time

4.3 Credit Expiration

Credits never expire. You can use your credits at any time, with no time limits or expiration dates. However, credits may be forfeited if your account is terminated for violations of these Terms.

4.4 Failed Generations

If a plushie generation fails due to a technical error on our end, the credit will be automatically returned to your account. Credits will not be refunded for failed generations caused by:

• Unsupported or corrupted image files
• Violations of our Acceptable Use Policy
• Images that don't meet our quality requirements

4.5 Promotional Credits

We may offer promotional credits from time to time. Promotional credits may have different terms, expiration dates, or restrictions, which will be clearly communicated when offered.

5. Acceptable Use Policy

5.1 Prohibited Content

You agree NOT to upload images that contain:

• Nudity, sexually explicit content, or pornography
• Violence, gore, or graphic content
• Hate speech, discriminatory content, or harassment
• Content that promotes illegal activities
• Content that infringes on others' intellectual property rights
• Malware, viruses, or malicious code
• Private or confidential information of others without consent

5.2 Prohibited Activities

You agree NOT to:

• Attempt to hack, reverse engineer, or compromise the Service
• Use automated tools (bots, scrapers) to access the Service
• Resell or redistribute our Service without permission
• Abuse or overload our systems
• Create multiple accounts to exploit free trials or promotions
• Impersonate others or misrepresent your affiliation
• Collect or harvest user data without consent

5.3 Enforcement

We reserve the right to review uploaded content and take action against violations, including but not limited to:

• Removing violating content
• Suspending or terminating your account
• Reporting illegal activities to law enforcement
• Forfeiting unused credits without refund

6. Intellectual Property

6.1 Your Content

You retain all ownership rights to the images you upload ("Your Content"). By uploading content, you grant PlushifyMe a limited license to:

• Process your images to generate plushie designs
• Store your images and generated designs in your account
• Display your content back to you within the Service

We will NOT use your images for marketing purposes or share them publicly without your explicit consent.

6.2 Generated Plushie Designs

You own the generated plushie designs. Once a plushie design is created from your uploaded image, you have full rights to:

• Download and use the design for personal purposes
• Use the design for commercial purposes (selling products, marketing, etc.)
• Send the design to manufacturers to create physical plushies
• Modify, edit, or create derivative works

You do not need to credit PlushifyMe when using your generated designs, though we appreciate it if you do!

6.3 PlushifyMe's Intellectual Property

The Service, including our website, logo, AI algorithms, and all content created by PlushifyMe (not including user-generated content), is owned by PlushifyMe and protected by intellectual property laws.

You may NOT:

• Copy, reproduce, or distribute our website or Service
• Reverse engineer our AI algorithms
• Use our name, logo, or branding without permission

6.4 Copyright Compliance

You are responsible for ensuring that you have the right to upload and use the images you submit. Do not upload images that infringe on others' copyrights, trademarks, or other intellectual property rights.

7. Payment and Billing

7.1 Payment Terms

• All payments are processed securely through our third-party payment provider
• We accept major credit cards and other payment methods as indicated

7.2 Refund Policy

30-Day Money-Back Guarantee: We offer a 30-day money-back guarantee on credit purchases. If you're not satisfied with PlushifyMe, contact our support team within 30 days of purchase for a full refund.

Refunds are subject to the following conditions:

• Request must be made within 30 days of purchase
• Unused credits will be forfeited upon refund
• Refunds for partially used credit packages will be prorated
• Abuse of the refund policy may result in account termination

7.3 Taxes

You are responsible for any applicable taxes (sales tax, VAT, etc.) based on your location. Taxes may be added to your purchase at checkout.

7.4 No Subscriptions

PlushifyMe operates on a pay-as-you-go model. There are no recurring subscriptions or automatic charges. You only pay when you purchase credits.

8. Limitation of Liability

8.1 Service Provided "As Is"

PlushifyMe is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability of results

8.2 No Guarantee of Results

While we strive to provide high-quality plushie designs, we cannot guarantee that:

• Every generation will meet your expectations
• The Service will be uninterrupted or error-free
• Defects will be corrected
• Results will be suitable for your specific purpose

8.3 Limitation of Damages

To the maximum extent permitted by law, PlushifyMe shall not be liable for any:

• Indirect, incidental, special, or consequential damages
• Loss of profits, revenue, or data
• Business interruption or loss of goodwill

Our total liability for any claims related to the Service is limited to the amount you paid to PlushifyMe in the 12 months preceding the claim.

8.4 User Responsibility

You are solely responsible for:

• Ensuring you have the right to upload and use your images
• Compliance with all applicable laws when using our Service
• How you use the generated plushie designs
• Any disputes arising from your use of the designs

9. Account Termination

9.1 Termination by You

You may delete your account at any time from your account settings. Upon deletion:

• All your uploaded images will be permanently deleted
• All your generated plushie designs will be permanently deleted
• Any unused credits will be forfeited (no refund)
• Your account data will be removed within 30 days

This action cannot be undone.

9.2 Termination by PlushifyMe

We may suspend or terminate your account if:

• You violate these Terms of Service
• You violate our Acceptable Use Policy
• You engage in fraudulent or illegal activities
• Your account has been inactive for over 2 years
• Required by law or government authority

We will provide notice before termination when possible. In cases of severe violations, we may terminate immediately without notice.

9.3 Effect of Termination

Upon termination:

• You lose access to the Service immediately
• Unused credits are forfeited without refund (except as required by law)
• We may delete your content and data
• These Terms remain in effect for past activities

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on this page
• Updating the "Last Updated" date at the top
• Sending an email notification for significant changes
• Displaying a notice when you log in

Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Service and may delete your account.

11. Governing Law

11.1 Jurisdiction

These Terms are governed by and construed in accordance with the laws of the United States and the State of California, without regard to conflict of law principles.

11.2 Dispute Resolution

11.3 Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in California.

11.4 Class Action Waiver

You agree to resolve disputes with PlushifyMe on an individual basis and waive your right to participate in class actions or class-wide arbitration.
